AQUIFER PROTECTION AGENCY
MINUTES OF A MEETING
APRIL 3, 2008

Members Present: Don Bascom (Chairman), Peter Clark, Bruce Tyler (Alternate), Alan Kenney, Ken Woodward (Alternate), Bette Jenak

Members Absent: Ellen Roman

1. Call Meeting to Order

Chairman Don Bascom called the meeting to order at 7:00 p.m.

2. Introduction of Members and Seating of Alternates

Members introduced themselves. Bruce Tyler was seated for Ellen Roman.

3. Accept Agenda

Add Item 3a (Adopt boundary of the Aquifer Protection Agency for the Gardiner Well Field) to the agenda.

MOTION by Mr. Tyler, SECONDED by Mr. Clark to accept the agenda as amended. VOTE UNANIMOUS. MOTION CARRIED.

3a. Adopt boundary of the Aquifer Protection Agency for the Gardiner Well Field

  • The Zoning Map was displayed by Ms. Rhodes. She told the Commission that we need to adopt level A mapping. There is one regulated area where there used to be a little marina, but it no longer exists. At this time, there is nothing there that needs to be regulated.

MOTION by Mr. Kenney to approve Zoning Map Amendment showing the boundary of the Gardiner Well Field Aquifer Protection Area.

Reasons: The State of Connecticut has mandated that Portland revise their Zoning Map to include the boundary of the Gardiner Well Field Aquifer Protection Area.

Effective Date: April 14, 2008

SECONDED by Mr. Tyler. VOTE UNANIMOUS. MOTION CARRIED.


4. Public Hearing for Proposed Aquifer Protection Area Regulations

MOTION by Mr. Clark, SECONDED by Mr. Kenney to open the public hearing. VOTE UNANIMOUS. MOTION CARRIED.

  • Ms. Rhodes read the following into the record:
    - Model Materials Management Plan.
    - Contact information for storm water management plan.
    - Application was referred on 2/14/08 to the Town of Portland Water Department & Cromwell Fire District.
    - Copies of potential fees to discuss. Facilities inspection monitoring fee will be $150.
    - Legal notices were published.
    - Copy of DEP's Level A area.
    - Transmittal from Kim Czapla.
    - Aquifer Protection Program Fact Sheet
    - Letter dated 8/21/07 from Kim Czapla, DEP. A portion of the letter was read into the record.
    - Ms. Rhodes asked the Commission to approve the model forms (i.e., model instruction form to be completed, model registration form and a model registration certificate).
  • Mr. Kelsey said the inspection fee of $150 for 5 years seems reasonable.
  • The fees will be included in the motion. Ms. Rhodes showed the Commission the Inspection Checklist and described the state forms that will need to be filled out.

  • None

MOTION by Mr. Tyler, SECONDED by Mr. Clark to close the public hearing. VOTE UNANIMOUS. MOTION CARRIED.

MOTION by Mr. Tyler to approve Aquifer Protection Area Regulations with the following modifications: In Section 18 add a facility inspection/monitoring fee of $150 per year to the fee schedule. This fee is to be collected in an amount equal to five (5) years at the time of registration. That the State of Connecticut's model forms, including instructions, registration and Certificate of Registration be updated with Portland information and utilized as official documents of this Agency.

Reasons: The State of Connecticut has mandated that Portland adopt Aquifer Protection Regulations since a critical water supply aquifer has been identified to fall within Portland's borders. These Regulations protect mapped Aquifer Protection areas by protecting them from contamination through management of land uses.

Effective Date: As required by procedure, the Agency will adopt an effective date after the Regulations are reviewed and approved by the DEP.

SECONDED by Mr. Clark. VOTE UNANIMOUS. MOTION CARRIED.

5. Approve March Minutes

MOTION by Mr. Tyler, SECONDED by Mr. Clark to approved the minutes as read. VOTE UNANIMOUS. MOTION CARRIED.

6. Adjourn

MOTION by Mr. Tyler, SECONDED by Mr. Clark to adjourn the meeting at 7:15 p.m. VOTE UNANIMOUS. MOTION CARRIED.
