MINUTES OF A MEETING
FEBRUARY 7, 2008

1. Call Meeting
to Order

Bascom called the meeting to order at 7:00 p.m.
2. Introduction
of Members and Seating of Alternates
Members introduced
themselves. Bruce Tyler was seated for Ellen Roman.
3. Accept Agenda
MOTION by Mr.
Clark, SECONDED by Mr. Kenney to accept the agenda as read. VOTE
UNANIMOUS. MOTION CARRIED.
4. Discuss Model
Regulations
- Ms. Rhodes
stated that the by-laws of the Aquifer Protection Agency would
be the same as the Planning and Zoning Commission. This is the
first meeting of the Aquifer Protection Agency.
- Ms. Rhodes
handed out some documents to the PZC. One item was the power point
presentation of the training course that Ms. Rhodes attended,
which talked about the following:
- Aquifer Mapping - speaks about Level A (Gardiner Well field)
mapping and Level B (our own Town well) mapping.
- Municipal Agencies - Ms. Rhodes needs to get permission from
the board to send this over to the Regional Planning Agency, and
they will superimpose it on the zoning map
- Model Municipal Regulations - The regulations, which are fill
in the blank, need to be completed. We can't make any changes
to them.
- Getting Started - Implementation - Inventory of lists need to
be done.
- Regulatory Overview - How this board reviews the applications.
- Facility & Site Plan Review - What is required including
the materials management plan or storm waters management plan.
- The regulations
will not apply to Level B mapping. They only apply to Level A
Mapping. Any regulated use that falls within Level A will have
to come in for registration after we have the regulations done.
The only regulated use in Level A at this point is a boat marina,
and this is accessed through Glastonbury.
- Once all
the registrations are done, we won't have to meet very frequently.
We will only meet when a permit needs to be done and a new use
wants to come in which we cannot issue a permit for a regulated
use. Ms. Rhodes provided a list of regulated uses, which are specifically
different from zoning uses. Aquifer protection "trumps"
zoning.
- Most Planning
& Zoning Commissions in the State of Connecticut are the Aquifer
Protection agency.
- Ms. Rhodes
also provided documentation as follows:
- Regulated Land Use Activity Table
- Fee Schedule
- Form for Regulated Activities in Aquifer Protection Areas
- A Model Form for Developing A Materials Management Plan for
Regulated Activities in protected areas.
- At this point,
Ms. Rhodes needs authorization to go ahead and have the Gardiner
Well Field put on the zoning map, for her to fill in the blanks
on the model regulations, and to set a meeting date for about
one month from now.
MOTION by Mr.
Tyler, SECONDED by Mr. Clark to give Ms. Rhodes the authority to
go ahead and have the Gardiner Well Field put on the zoning map,
for her to fill in the blanks on the model regulations, and to set
a meeting date for about 1 month from now. VOTE UNANIMOUS. MOTION
CARRIED.
5. Create Meeting
Schedule
- Ms. Rhodes
set the next meeting date for 3/6 from 7:00 - 7:30.
Questions on
Implementation:
- Mr. Tyler
asked about implementation deadline, which is set in June. Mr.
Tyler asked if we would be out of compliance if we don't have
Level A mapping completed by June. Ms. Rhodes said they were very
loose about it.
- Rick Kelsey
responded that it should be done by June 08, and yes we will be
out of compliance if it's not done. Mr. Tyler asked Mr. Kelsey
if there is $55,000 in the budget for Level A mapping for 2008/2009?
Mr. Kelsey said yes there is. Mr. Kelsey said it should take about
1½ years to complete and be in compliance.
- Mr. Bascom
said at this point he feels that as long as we're working on it,
even though we're not done, is what is important.
- Ms. Rhodes
spoke about the types of things that appear on the Land Use Activity
Table. The concerns are regarding "dirty uses" that
are detailed on the table. Farming, agriculture and residential
are not regulated.
6. Adjourn
MOTION by Mr.
Clark, SECONDED by Mr. Kenney to adjourn the meeting at 7:19 p.m.
VOTE UNANIMOUS. MOTION CARRIED.
